Unlawful Possession of a Weapon Charges Dismissed in Essex County
Today in Essex County, the Law Offices of Jef Henninger, Esq. were able to help a client get his second degree weapons charges completely dismissed. The client, M.D., was a security guard that was looking to become an armed guard. He applied for a carry permit and his company gave him a letter of need. He thought this was good enough. Problem is, his carry permit was not approved yet. The police saw him leave his house with his gun and he was arrested immediately and his gun was confiscated.
Despite this reasonable explanation, the State still sought an indictment against him. If convicted, he was looking at mandatory prison time up to 10 years. Unlike other cases that have been in the news lately, this firm did not seek to publicize this case. As a result, the client’s name will not appear in any Internet searches for the rest of his life. Because our fees are reasonable, there was no big fundraising campaign needed. Even more importantly, this case was 100% dismissed. There was no probation, no pre-trial intervention and no fines. He can also get his weapons back.
Please note that this is not to say that media attention is not a proper strategy in some cases. However, there seems to be some people that think this is the only way to win the case and as a result, they forego hiring the right lawyer. Or they think it will be too expensive and thus, something they cannot afford. This case demonstrates that what is necessary in some cases is not necessary in others. Before making any assumptions, speak to a lawyer first.

Many applicants get hung up on the question about being adjudicated a delinquent on the gun permit application (STS 33). This client was one of them. Ocean County Gun Forfeiture
This case was a huge challenge. The client had a number of mental health issues. As a result, the police were called to his house because he threatened to kill himself. As if this wasn’t bad enough, it happened again. He was then hospitalized for some time. His guns and FID card were seized and the State filed a complaint for forfeiture. Not every case can be a walk in the park so we fought hard for the client. It took two court appearances but we were able to get the client his FID card and weapons back. He plans to move out of New Jersey as soon as possible.

Morris County Gun Permit Appeal Lawyers Win Case
This was a very tough case. The client had a criminal record in New York for over 30 years ago. He was denied for alleged falsification on his application for failing to disclose this alleged conviction. However, we argued that it was not a conviction at all. Trying to research the law from New York as it existed over 30 years ago was not easy. For every point we made, the State had something to fight against it. While we have fought against the State in many gun permit appeals up and down the State for many years, we have rarely seen the State fight so hard. They threw everything they could at this case. Nevertheless, the judge found in our favor and the client was granted a gun permit.

Retired NYPD Officer Wins Gun Permit Appeal
This client was one of many applicants that have applied for a retired law enforcement permit to carry but was denied because the NYPD will not sign the required forms. As we have done in other cases, we were able to file the appeal and win the case so that the client can get his retired law enforcement officer’s carry permit. I have heard that there are some judges that are not so forgiving on these applications but we have avoided any losses on these appeals so far. There is no case law that I am aware of yet on this topic but at some point this judge (or judges) will wind up forcing this issue up to the appellate division.

New Brunwick Gun Permit Appeal Lawyers Wins Appeal
In this case, the client was denied his gun permit because he had a Final Restraining Order. He had no idea it was still on. Between the time he was denied and the time of the appeal hearing, the FRO was successfully vacated. Of course, this doesn’t mean that the gun permit appeal would automatically go through. By law, the State can still use the domestic violence issues against him. However, we fought back against the State and were able to win the gun permit appeal.
